Yes — form field content

Form field content (questions and field data) may be used to train Jotform AI. Personal data is not used for training. AI providers like OpenAI may use data to train their models. When interacting with AI Agents, personal data provided is secured but not used to train Jotform AI. (Per AI Policy and Privacy Policy revised Jan 12, 2026.)

AI features are optional; simply not using AI features avoids form-data-based training. No explicit opt-out toggle for data training. Marketing emails are opt-out via account settings.

Data retained while account is active and as needed for services/legal obligations. If account closed and forms made unavailable, personal data deleted within one month. HIPAA now starts at Gold tier

As of October 1, 2022, HIPAA compliance features are only available on Gold ($594/year with nonprofit discount) and Enterprise plans. Silver plan no longer qualifies for HIPAA for new accounts. Most competitors also gate HIPAA behind higher tiers.

Form data used for AI training

Unlike some competitors, Jotform DOES use form field content to train their AI models. Personal data is not used, but form content (questions and field data) is. This applies across all tiers.

AI Form Generator, AI Agents (chatbots with 720,000+ built since launch), AI Quiz Generator, AI Workflow Generator, Presentation Agents, and more. Agents can be deployed to Shopify, Gmail, Instagram, WordPress, and Salesforce.

Non-enterprise plans rely on Google Cloud/AWS infrastructure certifications. Direct SOC 2 Type II attestation (achieved September 2022) requires Enterprise plan.

For organizations with 5+ staff

Gold at $594/year (with 50% nonprofit discount) is the minimum recommended plan for organizations handling sensitive data, providing HIPAA + BAA. Silver ($234/year with discount) is good for higher-volume non-sensitive forms. Enterprise for SOC 2 + full compliance suite.

For organizations with fewer than 5 staff

Free tier (5 forms, 100 submissions) is good for testing. Bronze ($204/year with discount) for donation forms and non-sensitive data collection. Silver ($234/year) for more volume without sensitive data. Gold ($594/year) required if any healthcare or PHI data involved.

For health data or vulnerable populations

Gold minimum for HIPAA/BAA (not Silver — HIPAA removed from Silver for new accounts Oct 2022). Note that form field content IS used for Jotform AI training even on HIPAA accounts; HIPAA accounts use Google Gemini via Vertex AI. Enterprise for SOC 2 + maximum compliance and data residency options.
